		<description><![CDATA[A clarification of the facts in Doninger - the mass email was not what Avery was punished for. She with three other students sent the email and it generated emails and phone calls but none of the students were punished. Avery was punished solely for the blog that she wrote while off campus and there was no finding that any of the calls/emails were generated by the blog.  Interestingly, the lower court found that there was no evidence that any calls were due to the blog, but the Second Circuit found that there were calls!]]></description>
